Terms and Conditions

Definitions:

In these conditions:
The Customer means persons requesting the training (you/your Company)
Delegate/s means persons attending the training (you/your Employees)

1. General

1.1 These Terms and Conditions shall apply to all training carried out in the provision of services by APT Health and Safety Training Solutions Ltd to the Customer in accordance with any order confirmation authorized by the Customer. No additions to, or modifications of these Terms and Conditions shall have effect unless expressly agreed in writing by both parties and expressed to be amendments to these Terms and Conditions.

2. Health & Safety

2.1 The parties to this Agreement shall ensure that all necessary steps are taken for securing the health, safety and welfare of all persons engaged in the operation of this Agreement. This will be to the same extent and In the same manner as an employer is required to do in relation to his, her or Its employees under the Health and Safety at Work Act 1974 (or any subsequent Act, Acts or enactments replacing the same or any other relevant legislation for the time, being in force in Great Britain).

3. Liability

3.1 APT Health and Safety Training Solutions Ltd will not be liable if we cannot provide the services to you because of an event beyond our reasonable control. Such events include (but are not limited to) events such as fire, flood, storm, strikes or other industrial action, failure of telecommunications services, war, riot, or the actions of any government or public body, failure or insolvency of the learning centre. If we are prevented from providing the services by such an event, we will take all reasonable steps to try to reinstate the provision of the services to you as soon as is reasonably practicable.

3.2 In no event will we be liable for any loss of profit, loss of earnings, loss of anticipated savings, loss of revenue or loss of goodwill that you may suffer.

3.3 ln no event will we be liable to you for any indirect or consequential loss that you may suffer.

4. Equipment

4.1 The Customer shall make available all facilities, materials, equipment and protective clothing necessary tor the training and/or assessment, unless APT Health and Safety Training Solutions Ltd has specifically agreed to provide them.

5. Course content

5.1 Our course listing is provided for information purposes only and does not constitute an offer for a particular course or programme.

5.2 APT Health and Safety Training Solutions Ltd constantly strives to improve the content of its courses and therefore reserves the right to modify the specification of a course; a course title, duration, cost, content and location are liable to change at any time. Modifications will be communicated to the Customer two weeks prior to the course start date.

5.3 Course Suitability

5.4 lt is the Customer’s responsibility to ensure that they have read and understood the course outline/content and that the course is suitable for their requirements.

5.5 APT Health and Safety Training Solutions Ltd reserves the right to ask a delegate to leave the training event if the delegate does not meet the course requirements

6. Certification

6.1 Certificates are awarded only to those delegates who successfully complete the training.

6.2 In-house Course Certificates will be issued to the Customer/Delegate within 1 weeks of attendance on a course.
Accredited Certificates will be issued to the Customer/Delegate within 10 weeks of attendance on a course.

6.3 Certificates will only be issued once full payment has been received.

7. Special requirements

7.1 It is the Customer’s responsibility to ensure that APT Health and Safety Training Solutions Ltd are notified of any special requirements – APT Health and Safety Training Solutions Ltd will make every effort to accommodate these.

8. Refreshments

8.1 Tea/coffee/Juice will be provided on arrival as well as at mid-morning and/or mid-afternoon breaks.

8.2 Lunch is not provided unless by prior arrangement; there is a café on site which can cater for all needs.

8.3 APT Health and Safety Training Solutions Ltd operates a No Smoking Policy on all APT Health and Safety Training Solutions Ltd Sites.

9. Parking

9.1 Stoke – extensive free car parking is available on site which is also free of charge.

10. Delegate requirements

10.1 Delegates are required to be punctual at all courses and sessions.

10.2 Delegates shall act reasonably throughout the training. APT Health and Safety Training Solutions Ltd may remove a Delegate from a course, where, in the opinion of the Trainer (which shall be final), the Delegate Is behaving unreasonably.

10.3 Consumption of alcohol is not permitted during training, nor should it be consumed immediately prior to training. If there is any evidence of such, trainers are obliged to refuse to train the delegates

10.4 Where the training being provided is other than theoretical, delegates must be physically fit to withstand the rigors of training. The onus is Entirely with the delegate to ensure his or her fitness to undergo training and APT Health and Safety Training Solutions Ltd cannot and will not accept any responsibility in this regard.

10.5 For all APT Health and Safety Training Solutions Ltd courses, all delegates must have a basic understanding of the English language.

10.6 All delegates will be required to abide by any site rules and regulations operating at the course location.

11. Joining Instructions (Delegates)

11.1 Joining instructions including an outline of the course, course requirements/prerequisites, venue details and map will be issued approximately two weeks prior to the course. The onus is entirely with the Customer to ensure delegates receive such information/documentation; APT Health and Safety Training Solutions Ltd cannot and will not accept any responsibility in this regard.

11.2 You will also receive a courtesy call reminding you that the course is due.

11.3 If you have not received your joining instructions three days prior to the training course, please call 01782 213 428.

12. Joining Instructions (Trainers)

12.1 The onus is entirely with the Customer to ensure Trainer Joining Instructions (if applicable) Including; Trainer Induction, Trainer Medical Assessment, Trainer security clearance, Trainer ID and Trainer PPE are communicated to APT Health and Safety Training Solutions Ltd two weeks prior to the course.

13. Disclaimer

13.1 The information contained in all APT Health and Safety Training Solutions Ltd coursework & literature is distributed on an “As Is” basis, without warranty. While every precaution has been taken in the preparation of the training courses and associated literature, neither the author nor APT Health and Safety Training Solutions Ltd shall have any liability to any person or entity with respect to any offence, loss or damage caused or alleged to be caused directly or indirectly by the information contained in the coursework.
You hereby acknowledge and understand APT Health and Safety Training Solutions Ltd’s terms and conditions. Clauses are only made and acknowledged so long as this has been agreed with APT Health and Safety Training Solutions Ltd in writing specifying the section in question and the clause.

13.2 Notice period for cancellation or transfer

13.3 APT Health and Safety Training Solutions Ltd will provide a full refund or transfer to another course of the “course costs” if APT Health and Safety Training Solutions Ltd receive written notice of the cancellation of the course and it is received by APT Health and Safety Training Solutions Ltd 14 clear days prior to the course date. Cancellation or transfer to another course of the course after this period is subject to the following:

Please note that the date of receipt of the letter by APT Health and Safety Training Solutions Ltd will constitute the date of termination and NOT the date the letter was sent.

13.4 In the event that the named individual(s) on a customer’s booking cannot attend a course, named substitute(s) will be accepted providing prior notice has been given to APT Health and Safety Training Solutions Ltd.

13.5 Other arrangements for cancellation may be considered due to unforeseen circumstances. Please telephone as soon as you are aware of a problem with your booking.

14. Payment Terms

14.1 Full Payment on booking OR 30% of the total course cost on booking for non-account customers OR 30 days net invoice date if an agreed account customer.

14.2 A place on a training course will only be guaranteed when the deposit/full payment (if non-account customer) and signed Booking & Payment

14.3 Terms & Conditions document is received.

14.4 The balance is due 14 days prior to the course delivery date.

14.5 Failure to pay the balance may result in the loss of your deposit and your place/s withdrawn from a course.

14.6 Bookings do not constitute VAT Invoices. VAT invoices will be issued separately.

The Customer will be contacted by APT Health and Safety Training Solutions Ltd prior to the course to obtain payment of the remaining balance, if appropriate.

15. APT Facebook Competitions Terms & Conditions

15.1 Entries are limited to 1 per person. Entries from illegitimate or fake accounts will not be counted.

15.2 Unless stated otherwise, one winner to be picked at random. Prizes won are non-transferrable, and will only be available to the chosen competition winner.

15.3 Entries received after the specified closing date will not be counted.

15.4 Facebook in no way endorse, promote or are associated with this competition.
